₹10,000 થી ઉપરની business payments cheque થી કેમ જવી જોઈએ — Section 40A(3) explained (2026)

Lorry ખાલી થઈ ગઈ છે, driver office ના દરવાજે ઊભો છે, અને એને પોતાનું ₹18,000 નું freight cash માં જોઈએ છે. અત્યારે જ. એ account number પર NEFT થી નહીં જે એને "યાદ નથી", એ cheque થી નહીં જેને "ક્યાંક જઈને deposit કરવો પડશે". Cash.
Businesses એને રોજ pay કરે છે. Freight real હતું, પૈસા real હતા, prove કરવા માટે file માં signed bilty પડી છે. અને assessment ના time પર, Income Tax Department ને પૂરો અધિકાર છે કે એ એવું behave કરે જાણે આ expense ક્યારેય થયો જ નહોતો.
આ જ છે Income-tax Act નો Section 40A(3) — Indian business accounting નો સૌથી ચુપચાપ મોંઘો rule, અને account-payee cheque માટે law માં લખાયેલો અત્યાર સુધીનો સૌથી strong commercial argument. આ post cover કરે છે કે rule કેવી રીતે કામ કરે છે, ક્યાં સૌથી જોરથી કરડે છે, અને એ એક standing SOP જે આને non-issue બનાવી દે છે. Rule, એક paragraph માં
Legalese હટાવીને વાંચો તો આવું છે: કોઈ expense business deduction તરીકે claim કરો, અને જો તમે એક person ને એક દિવસમાં ₹10,000 થી વધારે cash માં pay કર્યું — કે એવા કોઈ mode થી જે account-payee cheque, account-payee bank draft, કે prescribed electronic mode નથી — તો એ expenditure disallow થઈ જાય છે. ₹10,000 થી ઉપરનો ભાગ નહીં. આખું expenditure.
આ penalty ની shape ફરી વાંચો, કારણ કે એ unusual છે. કોઈ તમારા પર fine નથી લગાવતું. કોઈ prosecute નથી કરતું. તમારો expense tax purposes માટે બસ exist કરવાનું બંધ કરી દે છે: taxable profit disallowed amount જેટલો વધી જાય છે, અને તમે એ rupees પર income tax ભરો છો જે ખરેખર business માંથી નીકળી ચૂક્યા છે. Cost real હતી. મરે છે deduction.
Intent પણ તમને નથી બચાવતો. Genuine vendor, genuine invoice, genuine payment — બધું irrelevant. Section exactly એક જ સવાલ પૂછે છે: પૈસા નીકળ્યા કેવી રીતે?
એ arithmetic જે લોકોને સીધા બેસાડી દે છે
Law ના કોઈ પણ paragraph કરતાં વધારે જોરથી એક illustration લાગે છે. નીચેનો દરેક rate જાણી-જોઈને illustrative label કરેલો છે — તમારો actual slab તમારા અને તમારા CA વચ્ચેની વાત છે.
એક trading firm એક transporter ને એક દિવસમાં ₹75,000 cash માં pay કરે છે. Freight delivered, bilty signed, ledger entry passed. Assessment પર officer Section 40A(3) invoke કરે છે અને ₹75,000 આખું disallow થઈ જાય છે.
જો firm ના profits illustrative 30% પર taxed હોય, તો આ disallowance નો મતલબ છે લગભગ ₹22,500 નો extra tax — surcharge અને cess પહેલાં — એ પૈસા પર જે પહેલેથી transporter ના ખિસ્સામાં બેઠા છે. Freight ની cost ₹75,000 ન રહી. લગભગ ₹97,500 થઈ ગઈ. આશરે 30% નું premium, cash ની convenience ના બદલામાં, અને બદલામાં મળ્યું કંઈ નહીં.
હવે alternative: એ જ ₹75,000 account-payee cheque થી. Extra cost — એક cheque leaf.
Per person, per day — જ્યાં clever ideas મરવા આવે છે
Ceiling aggregate છે: એક person ને એક જ દિવસમાં કરેલા બધા cash payments, ઉમેરીને, એક limit ની against test થાય છે. એ એક word — aggregate — દરેક એ folk remedy ને મારી નાખે છે જ્યાં સુધી લોકો પહોંચે છે.
- Same supplier ને same day ₹9,000 ના ચાર cash payments? એ એક person ને એક દિવસમાં ₹36,000 છે. Disallowed.
- એક ₹40,000 નું bill પાંચ sub-₹10,000 cash vouchers માં split, બધા same date ના? Same answer. Section payments aggregate કરે છે, bills નહીં.
- Same vendor ને same day જુદા-જુદા ઘણા invoices ની against cash? તો પણ aggregated. Per person, per day — ક્યારેય per bill નહીં.
એ એક split જે technically law ના letter ને clear કરે છે — cash ને જુદા-જુદા દિવસોમાં ફેલાવવું — એ જ છે જેના પર કોઈએ system નહીં બનાવવી જોઈએ. Same vendor ને રોજ ₹9,900 cash payments નું neat pattern exactly એ વસ્તુ છે જેમાંથી scrutiny assessments બને છે, અને officer એ એક વાર એ દોરો ખેંચવાનું શરૂ કર્યું, તો expense ની genuineness જ microscope નીચે જતી રહે છે.
અને એક delayed fuse વાળો trap પણ છે: Section 40A(3A). આ વર્ષે કોઈ expense accrual પર book કરો, પછીના કોઈ વર્ષે એને ceiling થી ઉપર cash માં settle કરો, અને એ amount payment વાળા વર્ષમાં તમારી income treat થઈ જાય છે. Rule liability નો પીછો ત્યાં સુધી કરે છે જ્યાં સુધી એ properly discharge ન થાય. Annoying? હા. Rule તો rule છે.

જે row પર સૌથી વધારે લોકો પડે છે એ છે bearer cheque. "મેં cheque થી pay કર્યું" safe feel થાય છે. છે નહીં — section cheque નથી કહેતો, account-payee cheque કહે છે. Crossing વગરની એક bearer leaf counter પર currency notes માં encash થઈ શકે છે, તો Section 40A(3) માટે એ કંઈ પણ protect નથી કરતી. "Account payee" words વગરની એક plain crossing પણ gap છોડે છે, કારણ કે generally crossed cheque હજુ પણ કોઈ third party ને endorse થઈ શકે છે. એ બે parallel lines જેની વચ્ચે "A/C PAYEE" લખેલું છે — એ જ એક કાગળના ટુકડાને bank-account-થી-bank-account instrument બનાવે છે — crossed vs account-payee guide exactly બતાવે છે કે દરેક crossing શું કરે છે અને શું નહીં.
Same logic account-payee demand draft ને cover કરે છે, અને દરેક mainstream electronic rail — NEFT, RTGS, IMPS, UPI, cards, net banking — prescribed list પર છે, જે એક મોટું કારણ છે કે cheque vs digital નો choice workflow ની વાત છે, tax safety ની નહીં. Account-payee cheque અને NEFT ની વચ્ચે Section 40A(3) neutral છે. આ બંને અને cash ની વચ્ચે — બિલકુલ નહીં.
Transporters માટે ઊંચી ceiling
એક carve-out જાણવા જેવો: goods carriages ના plying, hiring કે leasing માટે કરેલા payments પર ceiling ઊંચી છે — ₹35,000 per person per day widely applied figure છે. Freight economics highway પર drivers ને cash advances પર ચાલે છે, અને law આટલી reality માની લે છે.
માને છે — surrender નથી કરતો. આપણું ₹75,000 વાળું illustration transporter ceiling ને પણ પાર કરી જાય છે. અને higher limit payment ની nature (goods-carriage hire) સાથે જોડાયેલી છે, દરેક એ માણસ સાથે નહીં જેની પાસે truck છે. તમને scrap વેચતો એક transporter ordinary ₹10,000 limit જ પામે છે.
Exceptions exist કરે છે — પણ narrow છે
Rules એવી situations carve out કરે છે જ્યાં ceiling થી ઉપરનું cash પણ પોતાની deduction રાખે છે. આ genuine impossibility કે policy ની categories છે, loopholes નહીં:
- ત્યાં કરેલા payments જ્યાં banking facilities available જ નથી — એ ગામ જ્યાં કોઈ branch નથી;
- agricultural produce અને allied products ના cultivators કે producers ને certain payments, first sale પર;
- government ને એ payments જે rules મુજબ legal tender માં કરવા જરૂરી છે;
- એ દિવસો જ્યારે banks બંધ હોય — strike, કે holiday — અને payment રોકાઈ શકતું નહોતું;
- કેટલીક employee-related situations, જેમ કે defined cases માં terminal benefits.
Categories, complete list નહીં — અને દરેક assessment પર narrowly વંચાય છે. જો તમે કોઈ exception પર ઊભા રહેવાનો plan કરી રહ્યા છો, તો એ વાતચીત તમારા CA સાથે cash drawer માંથી નીકળે એ પહેલાં કરવાની છે, notice આવ્યા પછી નહીં.
Mirror image: મોટું cash accept કરવાની પોતાની penalty છે
Section 40A(3) paying side ને police કરે છે. Receiving side નો પોતાનો, અને વધારે કડક, law છે: એક person પાસેથી એક દિવસમાં, કે એક transaction કે event માટે, એક defined threshold — ₹2 lakh widely applied figure છે — પર કે એનાથી ઉપર cash accept કરો, અને penalty received amount ની બરાબર હોય છે. કોઈ percentage નહીં. આખો amount.
જુદો section, જુદી mechanics, અને પોતાના જ details — અહીં point બસ એટલો છે કે Indian tax law હવે મોટા cash ને transaction ના બંને છેડેથી નિચોવે છે. Cash demand કરતો vendor પોતાની books નું પણ કોઈ ભલું નથી કરી રહ્યો.
એ SOP જે problem ખતમ કરી દે છે
India નો દરેક accounts person આખરે એ જ standing rule લખે છે, તો day one પર જ લખી લો: ₹10,000 થી ઉપરનું કંઈ પણ આ business માંથી cash માં નહીં નીકળે — ક્યારેય નહીં. Ceiling થી ઉપર, account-payee cheque કે bank transfer, અને CA ના written sign-off વગર કોઈ exception નહીં.
એ rule ને frictionless બનાવવો એ જ actual કામ છે:
- crossing automatic રાખો — દરેક printed cheque default થી "A/C PAYEE" carry કરે, જેથી safe version જ lazy version હોય;
